Der Umgang der nationalsozialistischen Justiz mit Homosexuellen
The thesis deals with the jurisdiction of homosexual delicts as well as with the punishment inflicted upon homosexual convicts in the prisons of the Third Reich. Judicial measures taken against homosexuals aimed at preventing such predisposed men from practising their homosexuality. There was no plan to "re-educate" homosexuals - solely the severity of measures was intended to bring about a change in behaviour. Although it has been argued that convicts in concentration camps were particularly discriminated against when they were homosexuals, this cannot be proved for the prisons. It is true that convicts who were imprisoned as homosexuals held a special position within prisons too; nevertheless, this status showed fewer characteristics of a vertical than of a horizontal structure. On the whole, national-socialist politics towards homosexuals resulted from the general assessment of homosexuality.
